How Are Student Loans Affected by Bankruptcy?

Filing Chapter 7 or Chapter 13 bankruptcy relieves an individual's obligation to pay back many debts, including credit card debt, medical bills and some taxes. However, in most cases, student loans are not dischargeable debts. Failure to pay back student loans may result in creditors garnishing your wages. This means that a portion of your wages will be deducted before you see your check and will then be applied toward your outstanding student loans.

The good news is that most student loan organizations will wait until after your bankruptcy is discharged before resuming collection attempts. Therefore, you will have discharged many of your debts or set up a repayment plan so you are better able to afford the student loan payments.

Can Student Loans Ever Be Discharged?

In some instances, student loans can be discharged. If failure to discharge a loan would cause hardship for you or your family, then the loan may be dischargeable. This requires providing proof that you cannot earn the money needed to repay the loan, such as if you are disabled, have a serious illness, have limited employment opportunities due to age, or have to provide around-the-clock care for a family member.
